When working at height, the duty holders must ensure when selecting the correct equipment. .....To use the most suitable equipment .....Give guardrails priority over personal protection such as harnesses and lanyards. .....Take account of the working conditions and the risks to the safety of all those at the place where the work equipment is to be used.

The work at height regulations (WAHR) published by the HSE in April 2005 brought together the relevant parts of the Construction (Health, Safety and Welfare) Regulations 1996, the Workplace (Health, Safety and Welfare) 1992 and the Construction (Design and Management) Regulations 2007. All of these refer to working at height and are incorporated within the WAHR The WAHR also implemented the 2nd amendment to ES directive (1989/655/EEC) which refers to Temporary Work at Height and the provision and use of work equipment. This is important because WAHR extended the existing provisions which covered only construction, to a wide range of other sectors.
